Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, APIs, and services (collectively, the "Services") provided by getmegabrain.com("MegaBrain", "we", "us", or "our"), located at Dubai, DIFC. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for maintaining the confidentiality of your account credentials and API keys, and for all activity that occurs under your account.

2. The Services

MegaBrainprovides a gateway that routes large language model (LLM) inference requests to third-party model providers, including an "Auto Model" routing capability. The availability of specific models and providers may change over time. We do not guarantee that any particular model or provider will remain available.

3. Acceptable use

You agree not to use the Services to:

• violate any applicable law or regulation;
• infringe the intellectual property or privacy rights of others;
• generate or distribute unlawful, harmful, or abusive content;
• attempt to disrupt, reverse engineer, or gain unauthorized access to the Services; or
• circumvent usage limits, billing, or abuse-detection mechanisms.

4. Fees and billing

Paid features are billed as described on our Pricing page. AI inference usage is billed at the applicable rates, and certain plans require a subscription or prepaid credits. You authorize us and our payment processor to charge your selected payment method for all fees incurred. Except as described in our Refund Policy, fees are non-refundable.

5. Third-party providers

The Services route requests to third-party model providers. Your use of those models may be subject to the providers' own terms and acceptable-use policies. We are not responsible for the outputs generated by third-party models.

6. Intellectual property

We retain all rights, title, and interest in the Services. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Services.

7. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that model outputs will be accurate.

8. Limitation of liability

To the maximum extent permitted by law, MegaBrain will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Services. Our aggregate liability for any claim will not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Termination

We may suspend or terminate your access to the Services at any time if you breach these Terms or to protect the integrity of the Services. You may stop using the Services at any time.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
